Pleneo Limited Warranty

This Pleneo Limited Warranty (the ‘Warranty’) is offered by Pleneo to the original end user (‘Customer’) of new Pleneo products, purchased only from Pleneo or a Pleneo Authorized Partner (Partner, Authorized Reseller). Pleneo warrants the Customer that the Product will be free from defects in materials and workmanship under normal use for a specified period (the ‘Warranty Period’), subject to the terms and conditions detailed herein.

This Warranty provides specific legal rights, and Customers may also have other rights which vary by jurisdiction.

The Warranty Period commences at the date either (a) the Product is sold by a Pleneo Authorized Partner to Customer; or (b) six months after the product is shipped from a Pleneo Distribution Center, whichever is earlier. Coverage under the Warranty is exclusively available to the original end user, and such coverage is not assignable or transferable.

Within the Warranty Period, Pleneo will, at its own option, repair or replace a defective Product covered under this Warranty provided Pleneo is informed of such defect within 30 days of its occurrence. If the repair or replacement of the Product is not reasonably possible, Pleneo will, at its discretion, credit the Customer the purchase price at original time of sale from Pleneo. Where the Customer has purchased the Product from an authorized distributor, the Customer should contact the original distributor to process a claim under this Warranty. Service under the Warranty is only available in the country or region of original purchase, and Pleneo and Pleneo Authorized Partners are under no obligation to perform service on products purchased in other regions. The Customer may return the Product to the original country of purchase at its own expense. Where local law requires Pleneo to provide additional rights and warranties in connection with the Customer’s purchase, Pleneo provides such warranties as may be required.

Products approved for repair or replacement under this Warranty must be accompanied by an RMA (Return Merchandise Authorization) number from Pleneo. Any required customs duties, taxes, clearances, certifications, insurance and transportation charges to Pleneo, a Pleneo Authorized Partner or authorized service center, for service under this Warranty, shall be the responsibility of the Customer. Pleneo is not responsible for damage, loss or theft to the Product while in transit. Pleneo, at its sole discretion, will determine warrantable failures upon receipt of Product or upon inspection of Product by a Pleneo Authorized Partner. All Product returned to Pleneo and replaced will become the property of Pleneo.

To receive the benefits of this Warranty, the Customer must provide proof of purchase from Pleneo or a Pleneo Authorized Partner that establishes the Customer as the original end user of the Product. Such proof of purchase must contain the Product’s serial number and date of purchase.

The Warranty does not cover the following individual product components: fans, hard drives, displays, external cables, external power supplies, capacitors, connectors, and consumables (such as batteries). Additionally, normal ‘wear and tear’ is excluded from coverage, and includes cosmetic damage such as scratches and chipping to external product casing, paint or coatings, and any damage to knobs, keypads, buttons, rotary encoders or covers.

The Warranty shall be rendered void if the Product serial number has been removed; the label tampered with or defaced; the Product rented out to others except the original end user; the Product damaged, abused or destroyed; repaired, inspected or examined internally by any person not authorized by Pleneo to make such repairs or inspections; damaged due to poor maintenance; operated outside of the published operating limits for the product; or installed in a manner inconsistent with Pleneo’s recommendations. This Warranty does not cover damage caused by accident, flood, fire, electrical surge, earthquake or other act of nature. Additionally, damage caused by abuse, misuse, improper or incorrect handling or installation of the Product is not covered under the Pleneo Limited Warranty.

Normal use means use in accordance with Pleneo’s published documentation, operating specifications, and environmental limits.

All software or firmware distributed by Pleneo is provided on an as-is basis, except as expressly stated in the applicable End User License Agreement (EULA) or where an additional support or warranty program for the software has been purchased directly from Pleneo. Furthermore, this Warranty does not apply to third-party products resold by Pleneo or to Pleneo products sold by companies designated as ‘unauthorized’ by Pleneo.

Pleneo, when providing service under the Warranty, may at its discretion, attempt to reinstall the Product’s original software and firmware upon completion of service. However, Pleneo will not provide any recovery, transfer of data or complete additional configuration to the Product not originally contained on it at time of sale. Once the Product has been repaired or replaced, its Warranty will be valid for the remaining period of the original Product’s warranty. This remedy does not cover any labor costs, travel time, or other operating expenses incurred by the Customer or a Pleneo Authorized Partner, diagnostics, installation or communication fees charged by such parties, or the cost of transporting the Product to Pleneo, a Pleneo Authorized Partner, or authorized service centre.

The remedy selected by Pleneo in accordance with this Warranty shall be the exclusive and sole remedy for any breach of Warranty. No action for breach of this Warranty may be commenced more than one year after the expiration of this Warranty.

No agent, employee, distributor or reseller of Pleneo is authorized to modify this Warranty, or to make additional warranties on Pleneo’s behalf. Statements, representations or warranties made by any reseller do not constitute a Pleneo warranty, and Pleneo shall not be responsible or liable for any statement, representation or warranty made by any third party. Pleneo makes no additional warranty except that contained herein.

THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED. PLENEO DISCLAIMS ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A SPECIFIC PURPOSE. PLENEO SHALL NOT BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF EARNINGS, PROFITS, USE, DATA, CLAIMS BY PURCHASER’S CUSTOMERS OR THIRD PARTIES, ARISING OUT OF THE PURCHASE, SALE OR USE OF THE PRODUCT(S), EVEN IF PLENEO WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

This Warranty shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles. Any dispute, controversy or claim arising out of or relating to this Warranty, including its existence, validity or termination, shall be finally settled by arbitration administered by the Singapore International Arbitration Centre (SIAC) in accordance with the SIAC Rules for the time being in force. The seat of arbitration shall be Singapore, and the language of the arbitration shall be English.

If any part of this Warranty is found to be void or unenforceable, then the remainder shall have full force and effect, and the invalid provision shall be partially enforced to the maximum extent permitted by law to effectuate the purpose of the Warranty.
